The Oscarandthewolf Websites are hosted by Shopify (Shopify Inc.), whose data centers are located in Canada.

 

1. INTRODUCTION

This Privacy Policy explains how we collect, process, use, and disclose your personal data when you visit the Oscarandthewolf Websites (your "Personal Data"). You will also learn why we process this data and on what legal basis.

2. WHO ARE WE?

Personal Data is collected via the Oscarandthewolf Websites by the company BV CLIMB X, a Belgian private limited liability company (acting as the data controller, hereinafter referred to as “we,” “our,” or “us”), with its registered office at Colombastraat 1, 3078 Kortenberg, Belgium, and registered under number 089 732 7303

Any request related to the processing and retention of your Personal Data can be sent to our team via the “?” button at the bottom of the website.

3. DATA PROCESSING: What Personal Data Is Currently Processed, Why, and For How Long?

Our content is generally accessible on the Oscarandthewolf Websites without the need to register as a user. However, in specific cases (for example, when subscribing to a newsletter, entering an online contest, or making a purchase), you may be asked to register or provide certain information through the Oscarandthewolf Websites. The Oscarandthewolf Websites may also collect your Personal Data even without user registration, such as your IP address, as detailed below.

a. Processing of Your Data When Placing an Order on the Oscarandthewolf Websites

Only the personal data you voluntarily provide in connection with the purchase of items on the Oscarandthewolf Websites is digitally saved and stored by us and/or our subcontractors.

The data processed when placing an order includes:

  • first and last name,

  • delivery address,

  • billing address,

  • phone number (to contact you more easily in case of any issues with your order or its delivery),

  • where applicable, the size of the items ordered,

  • email address,

  • company details if the order is made by or delivered to a company,

  • payment data (cardholder name, credit/debit card type, card number, expiry date, CVC code, etc.).

The processing of this personal data is necessary for the performance of the contract (or any pre-contractual steps) between us, in accordance with Article 6.1(b) of the GDPR. This includes, among other things:

  • managing and following up on an information request,

  • invoicing,

  • processing payment,

  • managing and fulfilling orders,

  • handling issues,

  • managing returns, particularly in the case of exercising the right of withdrawal,

  • managing legal proceedings.

Without this data, the contract cannot be fulfilled.

We retain this data (excluding banking data) until the expiration of the contractual statute of limitations as per the applicable law. Your banking data is retained only for the time necessary to complete the transaction and to comply with legal obligations and resolve disputes (including possible refunds). We reserve the right to retain your data for a longer period where necessary in accordance with Article 17.3 of the GDPR.

Unless otherwise stated in this Privacy Policy, we will not share any of this Personal Data with third parties, nor use it for commercial purposes, except when required to send information about the Oscarandthewolf Websites and their content if you have subscribed to the Oscarandthewolf newsletter (see point c. below), or with our subcontractors for the execution of our contracts with you.

Payments for your orders are processed via Shopify Payments and PayPal (Bancontact – credit card); your Personal Data (including your banking details) is processed directly by these services. We refer you to their respective privacy policies for further information.

You are encouraged to verify that these documents and links remain current. If necessary, please search for the most recent versions yourself.

b. Creating an Account

You may create an account (hereinafter referred to as the "Member Account") by clicking the profile icon at the top left of the homepage and selecting the "Sign up" link, or during checkout by clicking “Log in.” This will allow you to place future orders on the Oscarandthewolf Websites without re-entering your information each time.

The personal data processed for creating the Member Account includes:

  • first and last name,

  • phone number (for newsletter subscription),

  • address,

  • billing address (if different from delivery address),

  • email address,

  • order history.

Providing some of this information may be optional. You are invited to complete the form, where certain fields marked in bold and/or with an asterisk (*) must be completed to place an order and become a member (“Member”), while others are optional.

Your identifying information (i.e., name and surname, phone number, billing and delivery addresses, and email) is accessible and modifiable via the "Your Account" and "Addresses" pages in your Member Account. You agree to keep this information up to date.

This data processing is based on your consent, in accordance with Article 6.1(a) of the GDPR. You may withdraw your consent at any time without affecting the lawfulness of processing based on consent before its withdrawal. You can unsubscribe from the Oscarandthewolf Websites and close your Member Account by sending a message to our team using the "? Help" button at the bottom of the site.

Your personal data will be stored for as long as you remain registered as a Member on the Oscarandthewolf Websites and have not withdrawn your consent to the processing of your Personal Data.

 

Regarding the Member Account, the purposes of processing are as follows:

  • For the registration, maintenance, and authentication of the Member Account, which facilitates easier ordering on the Oscarandthewolf Websites;

  • To list the Members;

  • To manage and follow up on an information request, or to resolve an issue;

  • To place orders and access the order history.

In the context of registering as a Member:

  • You must provide accurate and complete identification information, and you must commit to updating it regularly. As a Member, you can update your identification information at any time.

  • You must choose a username and a password that will allow you to access your Member Account. This password serves to protect personal data and should remain confidential. We ask you never to share or communicate your password to anyone. You are responsible for any use of the Oscarandthewolf Websites by anyone using your username and password. You must immediately notify us if you have any reason to believe your username or password has been compromised. As a precaution, it is advised to log out of your Member Account at the end of each session.

  • It is forbidden to use an email address that infringes on third-party rights, particularly regarding name rights, trademark rights, copyright, neighboring rights, or any regulation that is contrary to applicable law, public order, or good morals.

c. The Oscarandthewolf Newsletter (via Shopify)

If you wish to stay informed about Oscarandthewolf’s projects and receive our newsletter, simply sign up either during the creation of your Member Account or while placing an order on the Oscarandthewolf Websites by checking the appropriate box.

If you would like to receive Oscarandthewolf updates via SMS, simply enter your phone number during the creation of your Member Account. If you do not wish to receive SMS updates, leave this field blank.

You will then receive information related to our activities, such as the release of a new album, the launch of new merchandise products, tour details, special events, information about potential humanitarian projects, marketing communications, contest launches, etc.

We process your email address and, if you choose to provide it, your phone number, when you voluntarily subscribe to the newsletter. The following data may also be processed: your operating system, your browser ID, other information about your system and connection, as well as your interactions with the emails we send you (such as what you click, when, and where you click, etc.).

This processing is based on your consent, in accordance with Article 6.1(a) of the GDPR, and your data will only be used for managing Oscarandthewolf newsletter subscriptions, sending the newsletter, and improving it.

You may withdraw your consent at any time without affecting the lawfulness of processing based on consent prior to its withdrawal. The newsletter will include a link to unsubscribe in future emails. Similarly, each SMS will include instructions for unsubscribing.

These data are retained for as long as we continue to send newsletters and until you withdraw your consent to receive them.

d. Other Possible Processing We May Implement

We may use your Personal Data (sometimes even without your explicit consent) to enhance your user experience, administer online contests, verify your eligibility for a contest, or for the realization, delivery, and organization of a prize.

We may collect usage information about you, such as your IP address and data on how you interact with the Oscarandthewolf Websites (such as the pages you visit, the links you click, and the duration of your visits).

e. Subject to the provisions of this Privacy Policy, none of your Personal Data collected will be shared by us with third parties (other than our subcontractors). We do not make automated decisions based on your personal data.

We do not process your Personal Data when your data protection interests or your fundamental rights and freedoms override the legal basis for our processing. We do not collect or process any other special categories of Personal Data about you, such as data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or other similar beliefs, trade union membership, genetic data, biometric data for the unique identification of a person, data related to health, sexual life, or sexual orientation.

4. HOW DO WE COLLECT YOUR DATA?

We collect Personal Data about you in various ways:

  • By Registration: Subscribing to our newsletters requires you to voluntarily register and provide us with your email address and, if applicable, your phone number.

  • By Contact: In some cases, you may contact us for press-related inquiries and provide optional data such as your company address, phone number (office, mobile, private), fax number, job title, gender, date of birth, interests, profile photo, links to your social media profiles, and professional title.

  • By Cookies, Pixels: We may also collect certain information when you visit our Oscarandthewolf Websites (even as an unregistered user) through cookies, pixels, and similar technologies. Detailed information on how we use them and the types of information collected via cookies is described below.

5. HOW DO WE USE YOUR PERSONAL DATA (Purposes of Processing)?

Your Personal Data will be used exclusively and only to the extent necessary for the following purposes:

  • Online Contests: To conduct the online contest, contact you regarding the prize, and/or inform you about the final winner.

  • Response to Requests: To respond to your direct requests, based on your specific consent, as indicated when we collect your Personal Data or as explained otherwise before using your Personal Data.

  • Album Release Information: To provide you with updates on Oscarandthewolf’s album releases.

  • Merchandise Sales: To process your orders and deliver merchandise to you.

  • Humanitarian Projects: To inform you about various humanitarian or non-profit projects and how you can potentially contribute to them.

  • Studio and Event Invitations: To send you invitations to studio sessions, events, and tours.

  • Tour Promotion: To promote Oscarandthewolf’s tours and associated events.

  • Promotional Emails and Marketing Offers: To send you promotional emails and/or SMS marketing offers related to Oscarandthewolf’s music, merchandise, and events. We will only do this if you have explicitly agreed to it.

  • Improvements: Based on your specific consent related to cookies, to analyze and understand the experience and habits of the audience of the Oscarandthewolf Websites, improve the service of the Oscarandthewolf Websites (including user interface experiences and performance), and optimize content selection and recommendation algorithms.

In any case, before using Personal Data for other purposes, our Privacy Policy will be updated, and we will inform you of the change. For activities based on consent, we will not process your Personal Data for new purposes without first obtaining your consent.

6. ONLINE CONTESTS AND SALES

In the context of administering online contests that you voluntarily participate in, the collection, use, and processing of Personal Data may be carried out by a third party, including our partners Waltex SRL and/or Mataro Advice SRL. We may also contact you after the online contest to provide you with information about similar or future events.

7. SHARING PERSONAL DATA WITH THIRD PARTIES AND TRANSFER OF PERSONAL DATA TO THIRD COUNTRIES

a. We carefully select our subcontractors (hosting providers, email campaign managers, services and tools, Website Oscarandthewolf managers, etc.) and ensure that they comply with GDPR rules. We specifically work with Waltex SRL, Mataro Advice SRL.

When we transfer your personal data to our subcontractors, we do so solely based on an agreement with our subcontractor, which limits the use of this Personal Data to the processing necessary to fulfill the subcontracting agreement, and requires them to take the necessary security measures to protect the data. However, we are unable to verify the actions or omissions of our subcontractors and cannot be held responsible for them.

We will not make your Personal Data available to third parties (other than our subcontractors) and will not publicly disclose Personal Data, unless these transfers are based on your specific consent, are necessary to perform a contract between you and us, or when such a transfer of Personal Data is otherwise permitted or required by law or ordered by an administrative or judicial authority.

b. Your Personal Data may be stored on servers located and/or may be transferred outside of the European Union, in accordance with Articles 44 and following of the GDPR. These transfers of Personal Data outside the European Union are based on the existence of a regulation considered to comply with the GDPR in the country where the data is stored or on the existence of an adequacy decision, appropriate safeguards (such as those provided for in Articles 46 and following of the GDPR), including the European Commission’s standard contractual clauses, binding corporate rules, etc.

Please note that whenever your Personal Data is transferred to processors or third parties located in countries outside the European Economic Area, which are not considered by the European Commission to provide an adequate level of protection for Personal Data, we will ensure that appropriate measures are implemented in accordance with applicable national and European data protection laws.

We retain your Personal Data for as long as necessary to achieve the purposes outlined above or as required by applicable laws concerning data retention and the legal retention periods for claims.

In the case where your Personal Data is processed for an online competition, we will retain your Personal Data for the duration of the competition.

We make every effort to ensure the security of the Personal Data we process.

You agree and acknowledge that the internet is not a fully secure means of communication, and as such, a complete guarantee of privacy cannot be assured. Therefore, our commitment is limited to an obligation of means, based on prudent and reasonable measures, and not to a guarantee of results.

We have implemented technical and organizational measures in line with industry best practices to ensure an adequate level of security for the Personal Data we process. The Oscarandthewolf Websites are protected by SSL encryption.

Nevertheless, security requires efforts from all parties involved. Therefore, we encourage you to contribute to these efforts by taking appropriate security measures yourself, including using strong passwords and maintaining the confidentiality of all usernames and passwords (if applicable).

12. CHILDREN ON THE OSCARANDTHEWOLF WEBSITES

The Oscarandthewolf Websites can be accessed by everyone.

However, if you are under 18 years old, participation in an online contest or a purchase transaction is strictly prohibited. Furthermore, by subscribing to the newsletter, you confirm that you are over 16 years old.

You may also request a restriction (temporary or permanent) on the processing of your Personal Data, in whole or in part, within the limits set out in Article 18 of the GDPR.

You can also object to the processing: the right to object allows you to refuse the processing of your Personal Data, without affecting any processing carried out prior to such refusal, and within the limits set out in Article 21 of the GDPR. The right to object may apply to certain types of communications. For example, if you no longer wish to receive the newsletter, you can unsubscribe from communications by clicking the link included in the emails you receive.

You also have the right to receive a copy of some of your collected personal data in a structured, commonly used, and machine-readable format (e.g., PDF document) or request that this data be directly transmitted to another data controller when technically feasible (right to data portability) within the limits provided in Article 20 of the GDPR.

We reserve the right, at our sole discretion, to change, modify, add, or remove any part of this Privacy Policy at any time without prior notice, by posting the modified version of the text on the Oscarandthewolf Websites. This Privacy Policy only concerns the management of the Personal Data we process and that is under our exclusive control. You are invited to review the privacy policy of our partners, for which we cannot be held responsible.

This Privacy Policy is fully governed by Belgian law, as well as all relations between BV CLIMB X and you regarding the processing of Personal Data that we carry out via the Oscarandthewolf Websites. In the event of a dispute, particularly regarding the validity, execution, or interpretation of this Privacy Policy, only the French-speaking courts and tribunals of the judicial district of Brussels will have jurisdiction.
