Sales Conditions

  1. Preamble
    These general terms and conditions of sale ("General Conditions") are concluded between WALTEX SRL, represented by MATARO ADVICE, a Belgian limited liability company with its registered office at 1190 Forest (Belgium), Avenue du Roi 107, and registered under number 0812.335.408 ("the Seller") and any person wishing to make a purchase through the present website (www.oscarandthewolf.fr; "the Site") for delivery within the European Union ("the Customer"). By confirming the Order, the Customer declares having read and unconditionally accepted the terms of this Agreement and the entire General Conditions.
  2. Application of the General Conditions
    The General Conditions aim to define the contractual relationship between the Seller and the Customer, as well as the conditions applicable to any purchase made through the Site. The General Conditions will take precedence over any other general or specific conditions not expressly agreed to by the Seller. The Seller reserves the right to modify the General Conditions at any time without prior notice: the conditions applicable will be those in effect at the date of the Customer's Order.
  3. The Products
    The products offered are CDs, vinyl records, textile merch and/or other media presented on the Site, each accompanied by a detailed description ("the Products"). These Products are offered subject to availability and as long as they are visible on the Site. If a Product becomes unavailable after the Order has been placed, the Seller will inform the Customer by email or phone: the Order will be automatically canceled, and the Customer will be fully refunded as soon as possible.
  4. Prices
    The prices listed on the Site are inclusive of all taxes but exclude processing and shipping fees, which are applied and detailed during the Order process. The Seller reserves the right to modify its prices at any time: the Products will be invoiced based on the prices in effect at the time the Order is confirmed, subject to availability.
  5. Geographical Area
    Online sales of Products through the Site are reserved for Customers residing within the customs territory of the European Union and for deliveries required within this geographical area.
  6. Orders & Preorders
    6.1 The Customer wishing to buy a Product online via the Site must follow the online ordering process, which includes a phase of identification, a phase of verification and validation of the selected Products and services, a payment phase under the agreed terms, and a confirmation phase of the order and payment ("the Order"). Confirming the Order implies acceptance of the General Conditions, acknowledgment of full knowledge of them, and waiver of applying their own purchasing conditions or other terms. The data provided and the confirmation recorded will serve as proof of the transaction. The Seller will send an email confirmation of the registered Order, which will serve as acceptance of the Order.

6.2 Some Products are available for preorder on the Site. If the Customer places a preorder, they must also pay the price of the Product in advance. The Customer can cancel their preorder at any time and receive a full refund for the preorder payments before the Product is shipped. Preorder payments do not guarantee the availability of the Product but represent an offer from the Customer to buy the Product when it is generally released. The Seller has the right not to accept the Customer's offer. The Customer's offer will only be accepted after payment and shipment of the preordered Product.

6.3 If both available Products and preorder Products are purchased by the Customer in the same Order, the Products will be shipped together, only when the preorder Products are in stock.

  1. Payment
    The price is due at the time of the Order. Online payments are made through a secure system to ensure that no third party can access the data transmitted. The debit will only occur at the time of shipment of the Order.
  2. Delivery
    Deliveries are made to the address provided in the Order form within the specified geographical limits. Any complaints regarding damage during transport must be made by a reasoned claim, a copy of which must be sent to the Seller within three days from receipt of delivery. Delivery times are indicative and include processing, shipping, and dispatch. The Customer has the right to cancel the Order if the delay exceeds 14 days, with a refund for the Products being made upon receipt of the full return of the Order in its original condition. The Seller is not liable for failure to meet delivery obligations due to force majeure events (strike, fire, flood, etc.). Shipping fees are the Customer's responsibility.
  3. Risk and Title
    The transfer of risks for the Products occurs at the moment of delivery. Ownership of the Products will be transferred to the Customer only when the Seller has received full payment for all sums due for the Products, including delivery fees.
  4. Right of Withdrawal
    Non-professional Customers have a 14-day withdrawal period from the delivery of their order to return (shipping costs at their expense) the Products to the Seller for exchange or refund without penalty. Returns must be made in their original, complete condition (packaging, accessories, instructions, and in the case of CDs and vinyl records, the plastic wrap should not be removed by the Customer) to enable resale as new, and accompanied by a copy of the purchase invoice. This right does not apply to immediately reproducible Products that have been unsealed and to customized Products.

Before returning the Product, the Customer must notify the Seller of their intention to exercise their right of withdrawal as follows: through the "? Help" button at the bottom of the site.

The Seller will refund the amount within 14 days following the receipt of the Customer's notification, provided the same payment method was used by the Customer at the time of the Order.

  1. Warranty for Non-compliance
    All Products delivered are covered by the legal warranty for non-compliance for a period of 2 years from the date of delivery. In case of non-compliance, the Products can be returned to the Seller at the Customer's expense, who will either replace or refund them. The warranty only covers defects or malfunctions occurring during normal use of the Products. (For example, a small scratch on the sleeve or box of a CD or vinyl record is not considered non-compliance. The same applies to normal wear on a record due to usage.)

All claims, requests for exchanges, or refunds must be made as specified with a reasoned claim and a copy of the invoice, within thirty days of identifying the non-compliance, sent to the Seller in the same way as outlined in Article 11.

  1. Liability
    12.1 The Seller, in the online sales process, is only bound by an obligation of means.

12.2 In case of force majeure, the Seller is not responsible for failure to fulfill its obligations.

12.3 The Seller's liability will not be engaged for any damage resulting from the use of the internet network, such as data loss, intrusion, viruses, service interruptions, or other involuntary problems, as well as any event deemed force majeure.

12.4 The photographs accompanying the Products are provided for illustrative purposes but cannot guarantee a perfect resemblance.

12.5 VAT, sales taxes, import duties, and other taxes are the responsibility of the Customer.

  1. Promotions
    Unless otherwise specified, the prices of the Products already include any applicable discounts. All offers are limited to stock availability. Promotions are not valid retroactively on previous purchases, including gift cards, vouchers, and shipping fees. Offers cannot be combined with other promotions, discounts, or codes. Promotions have no monetary value. The offer cannot be sold, transferred, or otherwise exchanged to any third party. Returns or cancellations of all or part of a purchase will result in a refund of the amount paid by the Customer at the time of purchase. No additional amount will be charged to the Customer. The Seller reserves the right to terminate or modify any promotion at any time and at its sole discretion. Other restrictions may apply. Offers apply only to countries authorized for shipping on the Site, unless otherwise stated.
  2. Personal Information
    Personal information is necessary for order processing and commercial relations. In accordance with the law on data protection, personal data relating to Customers may be subject to automated processing. Users have the right to access and rectify the data concerning them.
  3. Intellectual Property
    All elements of the Site are and remain the exclusive intellectual property of the Seller. Any partial or total reproduction of any part of the Products or elements on this Site is prohibited.
  4. Severability
    The invalidity or unenforceability of any provision of the General Conditions does not affect the validity or enforceability of the remaining provisions, which remain in full force.
  5. Applicable Law and Jurisdiction
    The General Conditions are governed by Belgian law. Any invalid provision will be replaced by the corresponding legal provision. In case of a dispute, the French version of the General Conditions will always be used as the reference text, and the courts in Brussels, Belgium, will have exclusive jurisdiction.

    The Terms are governed by Belgian law. Any dispute regarding the interpretation or execution of these Terms will be submitted to the exclusive jurisdiction of the courts in Brussels, Belgium.
